3. Description of Services

The following services are offered on the website fotoks.net:

  • photographic services (e.g., portrait, wedding, and studio photoshoots),
  • rental of clothing and accessories for photoshoots,
  • sale of gift certificates and photography training courses,
  • presentation of the photographer’s studio services,
  • publication of profiles of other photographers (for a fee).

4. Conclusion of Contract

The information about services on the website does not constitute a legally binding offer, but an invitation to submit a booking or order request.
A contract is considered concluded once the Photographer confirms the booking or order via email or through the website.

5. Prices and Payment

All prices listed on the website are final prices (including taxes, if applicable).
Available payment methods include:

  • cash,
  • bank transfer,
  • online payment (via payment services such as Stripe, PayPal, or others).

Payment is due immediately after the confirmation of the contract. For online payments, the terms and conditions of the respective payment service apply.

6. Gift Certificates and Online Courses

Gift certificates can be purchased on the website and redeemed within their stated validity period.

Access to online courses is granted after payment has been received. Refunds are not available once a course has started.

7. Clothing Rental Terms

Rented clothing and accessories may be used exclusively for photoshoots.
The client agrees to handle the rented items with care and return them within the agreed period.

In the event of damage or loss, the client is liable for the repair or replacement costs.

8. Copyright and Usage Rights

All photographs, texts, and design elements on the website are protected by copyright.

The rights to materials published on fotoks.net belong to:

  • the website operator (for original photographs),
  • photographers who voluntarily contributed their work, or
  • sources such as Pixabay and Pexels (royalty-free licensed content).

Commercial use or publication of materials without the author’s written permission is prohibited.

9. Use of Client Photographs

The Photographer may publish clients’ images (e.g., on the website or social media) only with their explicit consent.

10. User Accounts and Registration

Registered users may manage their bookings, purchase gift certificates, and access online courses.

The operator reserves the right to block or delete an account in case of violations of these Terms or applicable law.

11. Liability

The operator is liable only for damages caused by intent or gross negligence.
No liability is assumed for technical malfunctions (e.g., server issues, maintenance, or force majeure).

12. Data Protection

The protection of personal data is governed by the Privacy Policy (see the “Datenschutzerklärung” page on fotoks.net).

Personal data will not be shared with third parties without the user’s consent.

13. Final Provisions

The law of the Federal Republic of Germany applies.
Place of jurisdiction: Bremen, Germany.
Contract language: German.

If any provision of these Terms becomes invalid, this shall not affect the validity of the remaining provisions.
